Since the validation of his expulsion procedure by the Council of State, Tuesday August 30, Hassan Iquioussen remains untraceable. According to the Minister of the Interior Gérald Darmanin, at the initiative of the ministerial decree of expulsion, the track of a flight to Belgium is for the moment privileged.
In order to find him, an investigating judge established in Valenciennes (59), not far from the home of Hassan Iquioussen, in Lourches, issued, according to information from BFM TV, a European arrest warrant (MAE).
This legal process valid throughout Europe, allows the authorities of the Member States to arrest a person in order to execute a sentence imposed by one of them. In 2019, more than 20,000 EAWs were issued, according to the European Commission, and only a quarter executed.
Morocco-France: the Iquioussen affair comes to the diplomatic field
The preacher, aged 59, has been affected since July 29 by an expulsion procedure, after a refusal to renew his residence permit, which expired in June. The measure was first suspended by the Administrative Court, before being reinstated by the Council of State.
Is this arrest warrant legally valid?
Born in France and of Moroccan nationality, Imam Iquioussen is notably accused by the Ministry of the Interior of making “anti-Semitic remarks” and “a systematic discourse on the inferiority of women”. His father having made him renounce his French nationality before his majority, Hassan Iquioussen tried twice to obtain it again, without success.
The code of the entry and residence of foreigners specifies that the fact of evading an expulsion decision “is punishable by three years of imprisonment”. If he were to find himself in another country, however, this could be considered as his own voluntary execution of the deportation order.
Even if he were found in France in the coming days, the expulsion of the preacher would come up against another obstacle: the consular pass issued by Rabat in early August, valid for 60 days, has been suspended by the kingdom.
Morocco-France: the Council of State validates the expulsion of Imam Hassan Iquioussen
“I expelled 734 like Mr. Iquioussen,” said Gérald Darmanin on the set of CNews, the 1is September, to promote its action against Islamism. “This European arrest warrant amazes us, because if it exists, it would be based on an offense which in our opinion is not constituted”, since Hassan Iquioussen “has left French territory”, was surprised with the ‘AFP the preacher’s lawyer, Lucie Simon.
